Can I use my Will to protect my share of my home?

Following on from my last article, where I explored the issue of protecting your share of your home for the people you love or the causes that you hold dear, I'm going to be doing something a little bit different this time.

Many of you reading will be parents, so you probably don't need me to tell you that the video above features Elsa's castle.

It is not mine, but my daughter has kindly allowed me to use it for demonstration purposes.

So, for this demonstration, please try to imagine that Elsa's castle is actually your home.

Now, both you and your partner have worked hard to build such a lovely, magical home.

You both would like your home to pass to your 2 children after you're gone.

You write simple Wills to reflect this wish.

Now, later on down the line you pass away.

A few years after this happens, your partner meets someone new - this person.

Now, this person also has 2 children.

What happens if your partner now passes away before this new partner?

There are rules in place to state that this new partner could get some or all of your home.

So, what can happen?

Your home passes to this person.

And so the question I have for you is, if that happened would this person pass any of your home to your children after they have gone?

If you answered 'no' or 'unlikely' then what happens is what we call 'sideways disinheritance' - and your children have missed out on what you wanted them to have.

So, does that concern you? If you could protect against that happening, would you do it?
